In July 2025, the High Court delivered a landmark decision by granting a discharge and acquittal to a Malaysian man and his Thai girlfriend who had been jointly charged with drug trafficking offences involving nearly two kilograms of dangerous drugs.
The couple had faced prosecution under Section 39B(1)(a) of the Dangerous Drugs Act 1952, a charge that carries the mandatory death penalty or life imprisonment, placing them at the very brink of the most severe punishment under Malaysian criminal law.
After the prosecution closed its case, the High Court found that the prosecution had failed to establish a prima facie caseagainst both accused persons. Critical elements required to prove trafficking — including possession, custody, and control of the drugs — were not sufficiently demonstrated. The Court further noted material inconsistencies and weaknesses in the prosecution’s evidence, which undermined the reliability of the case.
As a result, the Court ordered the immediate release and acquittal of both accused persons, sparing them from the death penalty and bringing an end to a prolonged and high-stakes criminal prosecution.
