Case Synopsis
(Magistrates’ Court & High Court — 2024–2025)
In 2024, a lorry driver was charged with the murder of his girlfriend, following allegations that he had pushed her from the 23rd floor of a condominium in Shah Alam. The incident drew nationwide attention due to the seriousness of the charge and the tragic circumstances surrounding the case.
The accused was charged under Section 302 of the Penal Code, an offence that carries the mandatory death penaltyupon conviction. During the early stages of the proceedings, defence counsel raised concerns regarding the accused’s mental condition at the time of the alleged offence.
Upon application and evaluation, the Court ordered that the accused be referred to Hospital Bahagia for psychiatric assessment and treatment, in order to determine his fitness to plead and stand trial as well as his mental state at the material time.
Subsequent medical reports were submitted to the Court, and hearings were adjourned to allow for the completion of psychiatric evaluation. The Court later ruled that the accused was fit to stand trial, paving the way for the matter to proceed to full hearing.
Throughout these proceedings, the accused was represented by Lawyer Sivahnanthan Ragava of Chambers of Sivahnanthan Ragava, who appeared on behalf of the defence in matters relating to remand, psychiatric referral, and case management before the Magistrates’ Court and the High Court.
This case illustrates the critical role of the defence in ensuring that:
-
An accused person’s mental health is properly assessed before trial
-
Procedural fairness is upheld in capital cases
-
The Court is fully informed before proceeding with a prosecution that carries the gravest possible penalty
Significance of the Proceedings
While the case remains subject to ongoing judicial determination, the procedural decisions taken thus far underscore essential safeguards in the criminal justice system:
-
Courts must ensure that an accused person is mentally fit before standing trial.
-
Psychiatric evaluation is a vital mechanism to protect both the accused and the integrity of the trial process.
-
Defence counsel plays a crucial role in raising and pursuing issues of mental capacity in serious criminal cases.
The handling of this matter reflects the importance of balancing public interest, victims’ rights, and the constitutional rights of the accused in cases involving allegations of extreme violence.
