KUALA LUMPUR – In a significant victory for the defecse, Sivahnanthan Ragava has successfully secured a full discharge and acquittal (bebas dan lepas) for an IT technician accused of outraging the modesty of a restaurant manager under Section 354 of the Penal Code.
The verdict, delivered by Magistrate Faezahnoor Hassan on January 30, 2026, highlights the importance of forensic digital evidence in the Malaysian legal system.
The Defense Strategy by Sivahnanthan Ragava
The prosecution’s case relied heavily on the testimony of the complainant. However, criminal defense lawyer Sivahnanthan Ragava represented that the critical CCTV footage from the scene in Mont Kiara, which is the 6-minute and 17-second recording clearly showed that the accused, Lim Wei Lun, never made physical contact with the manager, contradicting the allegations.
The court ruled that the prosecution failed to prove a prima facie case, and the accused was acquitted without being called to enter his defense.
“This acquittal is a reminder that objective evidence, such as CCTV, is the ultimate safeguard against wrongful accusations. We are pleased that the truth prevailed,” said Sivahnanthan Ragava following the court’s decision.
